ARTICLE 1 - Organizer and Duration of the Contest

The Conseil des Vins du Médoc (CVM), located at 1 Cr du 30 Juillet, 33000 Bordeaux Cedex (33075), registered with the RNA number W334000399 (hereinafter the "Organizing Company"), is organizing a free contest with no purchase necessary titled "Try to win a pass ‘vie de château’" from 09/01/2024 to 11/03/2024 included, accessible on the website https://upgrade-the-moment.medoc-bordeaux.com/ (hereinafter the "Contest").

ARTICLE 2 - Participation Conditions

2.1 The Contest is free, with no purchase necessary, and open to any adult individual residing in Metropolitan France, excluding anyone who has directly or indirectly participated in its development.

2.2 Individuals who do not provide complete and accurate personal information or who provide false information will be disqualified, as will those who refuse the collection, recording, and use of their personal data necessary for the management of the Contest.

2.3 This Contest will run from September 01, 2024 (12:00 am UTC + 1) to November 3, 2024 (12:00 am UTC + 1). It is accessible on the website https://upgrade-the-moment.medoc-bordeaux.com/

2.4 It is reiterated that this Contest does not require any purchase. To participate, one must have personal internet access and a valid email address.

2.5 Participation in the Contest implies express and unreserved acceptance of these rules, all its stipulations, the ethical rules in force on the Internet, as well as the laws and regulations in force in France.

ARTICLE 3 - Participation Methods

This contest takes place via digital forms to be completed online on the website https://upgrade-the-moment.medoc-bordeaux.com/. To validate participation, each participant must complete the form (email address, name, surname, date of birth, phone number and cellar visited). Each participant, by registering for the contest, gets one chance to be drawn. Only one form per participant will be accepted.

Any form filled out incompletely or with obvious errors regarding the participants' identity will not be considered and will result in the nullification of the participation.

ARTICLE 4 - Prize

A two-day stay in Médoc for two people, including flights, is at stake to discover the region and its wines. The program includes walks, tastings, and exploring the terroir.

ARTICLE 5 - Winner Selection

The Organizing Company will randomly draw the winner from all participants. A draw will be held in November 2024 by the Organizing Company. The winner will be contacted by email and/or phone. Each winner must confirm their postal details within 24 hours of the prize notification email. If confirmation is not provided within the specified time, the prize will be re-awarded under the same conditions, with no claim possible from the initial drawn participant.

ARTICLE 6 - Prize Distribution

Prize delivery is free of charge. The winner will receive confirmation of their prize by email to the address provided in the previously completed form, within a maximum of one month from the contest end date.

The prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash. In case of force majeure or any other circumstance beyond the Organizing Company’s control rendering the prizes unavailable, the Organizing Company reserves the right to replace the prizes with prizes of equivalent nature and value.

The Organizing Company cannot be held responsible for the inability to award the prizes due to incorrectly or incompletely provided email and/or postal addresses or address changes not communicated.

ARTICLE 7 - Free Participation

For participants using internet service providers, participation in the Contest is naturally free. Participants not incurring additional costs as part of their participation in the Contest will not be eligible for any reimbursement.

Additionally, internet service subscriptions and computer equipment (computer, modem, cables, etc.) are not reimbursed, with participants declaring they already have them for their use.

ARTICLE 8 - Responsibility

The Organizing Company disclaims all liability for any incidents and/or accidents that may occur during the enjoyment of the awarded prizes.

The Organizing Company cannot be held liable if, due to force majeure, events beyond its control, or justified necessity, it is required to shorten, extend, postpone, modify, or cancel the Contest.

The Organizing Company cannot be held responsible for any non-attributable events, such as mail misdelivery, phone line malfunctions, website unavailability, technical failures preventing the Contest from proceeding, interrupted communications, data transmission delays, participant computer failures, or any other issues related to communication networks, servers, internet service providers, computer equipment, or software, data loss, virus consequences, anomalies, technical failures, any technical, material, or software failure preventing or limiting participation in the contest or damaging a participant's system, prize delivery errors, loss during shipment, non-receipt or damage, or late delivery.

It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any harm. Connecting to the site and participating in the Contest is at the sole and entire responsibility of the participant.

It is strictly forbidden to alter or attempt to alter the game devices in any way, especially to change the results or any elements determining the outcome of a game and the winners. The Organizing Company reserves the right to enforce equal chances for all participants, including through legal means or any other means at its convenience.

The Organizing Company reserves the right to exclude from the Contest and take legal action against anyone who has attempted to cheat or disrupt the Contest. A cheating winner will be disqualified from any prize.

The Organizing Company cannot be held responsible for any damage related to the enjoyment of the prize. The Organizing Company will not be liable for any malfunction or poor performance of the awarded prizes.

ARTICLE 9 - Fraud

Participation in the Contest implies full and complete acceptance of these rules. Any fraud, attempted fraud, evidenced by a commencement of execution and committed to unduly obtain a prize, non-compliance with these rules, or any malicious intent to disrupt the Contest will result in the exclusion of its author, with the Organizing Company reserving the right to initiate legal proceedings against them. In case of dispute, participants must provide proof of compliance with these rules.

ARTICLE 10 - Claims/Disputes

No telephone inquiries regarding the Contest procedures, winner determination, or interpretation or application of these rules will be answered.

Any claim or dispute must be made in writing exclusively by postal mail to Conseil des Vins du Médoc, 1 Cr du 30 Juillet, 33000 Bordeaux Cedex, and must include the exact references of the Contest: "Try to win a pass ‘vie de château’."

Written claims and disputes related to the Contest will no longer be considered three months after the Contest closes, i.e. January 31, 2024.

ARTICLE 11 - Personal Data

In accordance with personal data protection regulations, Contest participants have the right to access, correct, and withdraw their personal data from the Organizing Company. Contact: favoreat@favoreatdesign.com

ARTICLE 12 - Accessibility of Rules

Any dispute regarding the application and/or interpretation of these rules will be decided solely by the Organizing Company.

ARTICLE 13 - Governing Law

This Contest is governed by French law.
